E29 Taking on Subsurface Risks: How to Allocate Subsurface Risk and Lessons Learned from an Owner, Contractor, and Geotechnical Expert (Room Chopin 3)

This program evaluates various risk allocation models for subsurface conditions and identifies effective methods for owners and contractors to manage those risks.  We will analyze the effects of disproportionate risk allocation and look at case studies from actual projects where subsurface conditions triggered large disputes.  It is important to understand geotechnical reports and use them as a tool for understanding and allocating risk.  A renowned Geotechnical Expert will discuss and illustrate how to do this.

Upon completion of this session, participants will be able to:

  • Understand the different types of subsurface contractual provisions; the advantages and disadvantages of various subsurface contractual provisions, from the owner, contractor, and engineer's perspective; and the history and evolution of subsurface contractual provisions.
  • Understand the cases where subsurface conditions were a major issue, including cases from the owner, contractor, and engineer's perspective; receive "lessons learned" about how to avoid subsurface disputes; and about negotiating subsurface contractual provisions.
  • Understand how to interpret geotechnical reports; about drilling and sampling methods; and how to avoid mistakes when interpreting geotechnical information.
