Interpreting fiduciary duty for licensed design professionals confuse courts, design professionals, and the construction bar.  However, a fully coherent solution exists but will change the entire construction industry.  A new view on a design professional’s implied duties radically changes issues related to limiting liability by contract, the use of standard AIA contract documents, the application of the economic loss doctrine, and the design-build project delivery method. This panel will make a compelling case that draws directly from case law and analogous relationships in other fields such as the financial world.
