E08 Loss of Productivity: The Advantages, Pitfalls, and Challenges of Developing and Implementing Recommended Standards (Room Chopin 2)

Loss of Productivity claims are often difficult to assess and quantify using objective rules and metrics. To address this challenge, the American Society of Civil Engineers (ASCE) convened a committee to develop non-mandatory, recommended standards for identifying and evaluating such claims. The panel will discuss the advantages, pitfalls and challenges encountered in developing standards related to addressing factual entitlement and quantification of losses. Panelists, including academic, industry, and legal professionals, will present the controversies that exist, recent legal findings that seem to undermine or reinforce some common practices, and differences between the ASCE's approach and other publications.

Upon completion of this session, participants will be able to:

  • Provide an early preview of the key elements of the ASCE's recommended standards and will be prepared to provide written comment when the draft is released for public comment in early 2018.
  • Understand recent legal decisions that seem to reinforce or undermine common practices that have been routinely described in other publications, recommended practices, or standards.
  • Understand how to utilize these recommended standards to their advantage and not be "trapped" by them.
