Profound changes are already taking place in many aspects of the construction industry, which traditionally has been slow to adopt new technologies. Construction projects are increasingly incorporating systems of digital sensors, intelligent machines, mobile devices, drones, and new software applications that are  integrated with a central platform of Building Information Modeling (BIM). 

Wherever new technologies have permeated this industry, the result is an almost 20% reduction in total life-cycle costs of a project, as well as substantial improvements in completion time, quality, and safety. These new technologies also have increasing use in the resolution of construction disputes.

This session will address the following: the innovative use of this emerging technology as part of an integrated strategy to successfully resolve construction disputes; how new technology, in particular the use of 3D printing, drone footage, and enhanced video modules, may be used during a construction litigation or arbitration; the need for attorneys to appreciate the benefits and challenges that come along with these new technologies; and, finally, how the precise and detailed data gathered through the emerging technology will likely give an upper hand to those attorneys who utilize the new technology, and how it will assist judges, juries, and arbitrators in developing a better understanding of the issues before them.

Upon completion of this session, participants will be able to:

  • Understand new technologies in the construction industry such as apps and mobile devices, Building Information Modeling (BIM) platforms, laser scanning, drones, and 3-D printers.
  • Identify the opportunities to incorporate the new technologies in the resolution of construction disputes, and the evidentiary issues associated with the technologies' use.
  • Understand the persuasive advantages of implementing these new technologies in successfully resolving construction disputes.
