E21 Examining the 2017 Decennial Updates to the AIA Form Contracts (Room Chopin 3)

Earlier this year, the AIA released its decennial updates to its 2007 standard form construction contracts. Included in those updates are many expected changes and some unanticipated modifications. The panel will examine and analyze the new documents in detail, including the changes to the termination, architect fee and means and methods provisions, and the addition of the sustainable project exhibit, with emphasis on how the new documents impact contract management and risk assessment. The panel will also explain and offer several alterations to the form contracts from their past experiences which tailor the AIA documents for better contract performance and dispute resolution, while analyzing the impacts (including security, confidentiality and other aspects) of the ACD5 web-based platform which will be the exclusive means of using the AIA documents beginning January 1, 2018.

The panel, consisting of in-house and outside counsel and experts will address the updated 2017 AIA form contract documents, focusing on:

  • Treatment of BIM and digital data
  • Dispute Resolution procedures and recommended modifications
  • Damages and Indemnification provisions under the new documents
  • Contract negotiations based on the AIA 2017 documents
  • Impacts of the requirement to use ACD5 for the AIA documents

Upon completion of this session, participants will be able to:

  • Understand the 2017 modifications and reasoning for those modifications.
  • Understand time-tested modifications to the AIA documents for use in future projects.
  • Understand dispute resolution procedures and recommended modifications Damages and Indemnification provisions under the new documents.
