E22 Ethical and Compliance Challenges Facing Counsel on the Industrial Mega Project (Room Chopin 4)

This will be a round table discussion of ethical issues facing in-house counsel for large construction contractors and engineering companies. The panel will focus on challenges associated with (1) ethical issues that arise in developing proposals for new contracts, (2) ethical components of corporate compliance, (3) requests from senior management or business units that could comprise the attorney's ethical obligations, (4) understanding specific ethical obligations in multiple jurisdictions, (5) understanding ethics rules in foreign countries, and (6) ethical and privilege considerations in fee agreements with outside counsel, experts and vendors.

Upon completion of this session, participants will be able to:

  • Provide practical advice on how counsel should address ethical and compliance issues that arise in providing advice during various elements of the construction process.
  • Help counsel understand ethical obligations when their employer or client does business in multiple jurisdictions.
  • Address ethical issues that can arise during dispute resolution or be created through tension that exists between court rules and client budgetary considerations.
