Sovereign Immunity, Patents and the Allergan Deal - A Tribal Perspective (Room N239)

Representatives of the Saint Regis Mohawk Tribe will provide an overview of the U.S. Patent Trial and Appeal Board (PTAB) process, and their ongoing litigation involving sovereign immunity before the PTAB.  The panel will explain the creation and structure of the PTAB system and the differences between the PTAB and Federal Court litigation. The panel will also discuss common misconceptions regarding the development of the Allergan deal, as well as the public relations and legislative responses that followed.  The Panel hopes to provide an informed perspective regarding the issues surrounding its assertion of sovereign immunity before the PTAB.
