Andrew Linden counsels alcoholic beverage manufacturers, wholesalers, and retailers with all facets of their business, including licensing and regulatory compliance, business formation, and product labeling. He assists craft breweries and distilleries with applications before the New Jersey Division of Alcoholic Beverage Control and retailers with applications before the local municipality. He provides guidance in connection with TTB federal permitting laws and advises clients with respect to federal and state labeling requirements and approval processes. He helps clients navigate state distribution and beer franchise laws. Andrew contributes to the firm’s Liquor Law Blog, highlighting legal and business issues affecting clients that make, sell, or distribute beer, wine, and spirits. He brings his experience of representing clients in highly regulated industries to the firm’s Cannabis Law Group, assisting marijuana entrepreneurs, suppliers, growers, retailers, and investors with navigating complex statutory and regulatory schemes, including those related to permitting and licensing (initial applications, transfers, expansions, changes to ownership, related disclosures), distribution, and general business operations (sales, storage of product, recordkeeping). He defends product liability, breach of warranty, and consumer fraud claims. Andrew handles complex commercial litigation matters such as shareholder disputes in closely-held companies, landlord/tenant actions, products liability and warranty claims, breach of contract actions, and property tax appeals. He regularly handles construction litigations, such as prosecuting and defending construction defect lawsuits and construction lien claims. His construction litigation experience also includes solar power matters, such as disputes arising out of engineering, procurement and construction contracts (EPCs), and related purchase power agreements (PPAs) and leases.
