David W. Oppenheim is Shareholder at Greenberg Traurig, LLP. Mr. Oppenheim concentrates his practice on domestic and international franchising, licensing and distribution matters. He advises both emerging and mature companies with respect to planning, structuring and implementing national and international franchise, distribution and licensing programs in the United States and abroad. David is also experienced in mergers and acquisitions and sophisticated financing transactions, including the securitization of a franchisor’s royalty stream. He represents private equity firms and public and private companies in the acquisition of franchise, licensing and distribution systems. David routinely counsels clients regarding the implementation of compliance programs and system-wide standards. He also advises franchise clients regarding complex franchise relationship issues and disputes. Mr. Oppenheim is a member of the ABA Forum on Franchising Governing Committee and currently serves as its Publications Officer and served as Co-Chair of the 39th Annual Forum on Franchising. He is a Past Chair of the New York State Bar Association Business Law Section, a current member of its Executive Committee and a Past Chair of the New York State Bar’s Franchise, Licensing and Distribution Committee. Mr. Oppenheim is recognized by Chambers USA as a leading, national franchise attorney. He has been featured in Best Lawyers in America annually since 2009 and was named its “Franchise Lawyer of the Year” in New York for 2013, 2017 and 2019. Mr. Oppenheim has served as the co-author of the annual Franchise Practice Commentary appearing in McKinney's New York Statutesand CCH's seminal analysis of the revised FTC Franchise Rule entitled FTC Disclosure Rules for Franchising and Business Opportunities.
