The moderator will lead a discussion of in-house counsel and experienced trial counsel in the best practices for responding to and addressing major defective workmanship claims that arise either before or after completion of large, complex construction projects. Topics covered include: (1) formulating a response to the Owner; (2) identifying and retaining appropriate experts; (3) navigating notice and opportunity to cure requirements; (4) the benefits and risks of attempting to shift blame; and (5) the use of Builders Risk and CGL policies to resolve claims early.

Upon completion of this session, participants will be able to:

  • Understand the best practices for determining whether the GC should respond and, if so, how to respond.
  • Understand the best practices for dealing with notice and opportunity to cure requirements including when to shift blame to others.
  • Understand the effective use of and complying with Builders Risk and/or CGL insurance policies to obtain early and successful resolution.
