Litigating or resolving disputes on an ongoing project comes with its own unique challenges. Managing relationships, delays resulting from litigation, and discovery that is being created in real time are realities that may influence strategies on a project in litigation. In this session, attendees will learn the risks and challenges of litigating an existing project and will be introduced to best practices on how to complete a project while in litigation.

Upon completion of this session, participants will be able to:

  • Obtain an understanding of how to manage the operational and legal aspects of a project in litigation.
  • Understand practical recommendations for managing litigation or dispute resolution on an existing project. These will include best practices for discovery and witnesses, communications during the project between parties in a dispute or litigation, and handling claims between multiple parties.
  • Understand practical guidance on how to address discovery when litigating an existing project. It will also identify how parties can balance responding to the litigation process while timely completing a project.
