ATY7 | The Value of Non-Monetary Settlements (Room Salon M-N)

Federal agencies are coming under scrutiny from Congress and the Administration for providing monetary settlements to federal workers in employment matters. Some agencies, like the Department of Veterans Affairs, have responded by implementing new policies on when a monetary settlement can be provided. In what may be a new era of scrutiny, agencies may have to begin facilitating non-monetary or low monetary settlements. At the same time, EEO complainants have longed for an apology as part of a settlement, which has typically been rejected as exceeding “make whole” relief. Our panel will review agency policies and consider when to limit monetary settlements. In addition, you will learn when and why to make non-monetary or low-monetary settlement offers and when to include apologies, mentoring, details and like remedies. You’ll learn which concrete suggestions can work on which non-monetary settlement offers — and when.
