Employment class action lawsuits under the federal Fair Credit Reporting Act (FCRA) are dramatically increasing, and a new trend for the plaintiff’s bar is emerging: allegations that the employer failed to provide appropriate pre-adverse action notices and waiting periods. Meanwhile, the rise of ban the box (BTB) laws at city, county and state levels has further increased the risk of legal noncompliance. Many of these new laws go beyond FCRA mandates and require special disclosures and information be provided in the adverse action process.
