Special education employees enjoy the full panoply of constitutional and statutory protections accorded public employees generally, and may have additional protection under federal and state antidiscrimination and whistleblower laws and union contracts. This session will chart the boundary line between legally protected employee conduct and bad behavior that may expose staff members to disciplinary consequences. Attorney David Rubin will discuss internal investigations, working with law enforcement, and respecting employee privacy rights. Special attention will be given to the challenges posed by employees’ use of computers, personal devices, and social media. With a strong understanding of the principles of due process and fundamental fairness, you’ll be better prepared to manage employee misbehavior.
