The term “substantially limits” has been included in Section 504 eligibility criteria since the implementation of the regulations, yet it continues to be a mystery to many 504 committees. By comparison, the other parts of the first prong of 504 eligibility — the determination that a student has an impairment that impacts a major life activity — are relatively straightforward. Consequently, most of the uncertainty in 504 eligibility determinations comes from grappling with whether the student is “disabled enough” to be substantially limited. School attorney Dave Richards will outline practical considerations for 504 committees as they apply the substantial limitation standard, including to students with temporary impairments and twice-exceptional students who are impaired but are performing well academically.
