The Every Student Succeeds Act requires state education agencies to develop plans to reduce the overuse of disciplinary practices, such as seclusion and restraint, shown to have a disproportionate impact on students with disabilities. There has been an uptick of individual claims by families alleging that schools have inappropriately implemented seclusion and restraint with special education students. Attorney Karen Haase will review the laws and regulations regarding the use of disciplinary practices, including a summary of how state plans are addressing this issue. She will also review state and federal litigation regarding seclusion, restraint, and other negative forms of discipline. You’ll take away practical suggestions on how to address these difficult issues in IEPs and, if necessary, in litigation.
