Your district has an obligation to provide assistive technology to students with disabilities if needed for FAPE. In Endrew F., the Supreme Court clarified what level of educational benefit is necessary to meet the FAPE standard. This decision has significant implications on your assistive technology decisions. It also impacts your decisions on using technology to track student progress to demonstrate compliance with the Endrew F. standard. Similarly, under Section 504 districts must provide assistive auxiliary aides needed to provide “equal opportunity” to students — and parents who believe their child needs technology may be able to sue without exhausting administrative remedies.
