Often one IEP team member writes notes,and summaries of the meeting to help clarify the topics and the key points of the IEP team’s discussion. These summaries are scrutinized by hearing officers and courts in IDEA litigation and should be drafted with some care. Attorney Jose Martin will propose useful techniques for writing clear and concise IEP team notes that accurately set forth the team’s discussion, parent points of input, and ultimate team determinations. The session will identify problematic drafting tendencies, propose a simple outline model and focus on documenting consideration of parent positions to prevent potential predetermination claims. Leave this session with samples of summary drafts, along with ideas about what does and doesn’t work.
