OSHA’s controversial final rule on electronic recordkeeping is now in effect and requires program changes and significant worker training, in addition to submission of injury/illness data electronically to the agency for public review. The anti-retaliation provisions affect injury reporting protocols, safety incentive programs, disciplinary systems and even post-accident drug testing. This session will explain what constitutes discrimination against injured workers, what key elements should be in a “reasonable” injury reporting and drug testing program, how safety incentive programs can be legally structured, and how to defend against costly citations that can arise under the new rule.
