In this session for practicing attorneys, Eric G. Rodriguez, a school lawyer who represents public schools, will focus on some of the ethical issues at play during special education litigation. His emphasis will be on the attorney’s duty to properly assess the case so that the client is fully informed about the potential strengths and weakness of his or her position and can provide the attorney with reasonable direction. It’s called giving the client the good, the bad, and the ugly, and both school attorneys and parents’ attorneys have a duty to take such an assessment seriously. Using relevant practice scenarios, Eric will pinpoint ethical threats that are unique to the field.
