This session will examine best practices and legal requirements related to the investigation of and response to the occurrence of sexualized behaviors within the special education context. Using cross-disciplinary references, attorney David Walker will help you gain a deeper understanding of the nuances and pitfalls associated with conducting investigations involving inappropriate sexualized conduct. Specific focus will be given to the importance of properly assessing and identifying the function of a sexualized behavior, conducting manifestation determinations, and the potential use of alternative forms of discipline. The session will also focus on appropriate responses when a student with a disability is a victim, perpetrator, or witness, as well as related legal obligations and best practices to engage in a complete and comprehensive response to student sexualized conduct.
