With legislative action stymied by partisan gridlock, the Executive branch of the federal government turns to the regulatory process to put its stamp on public policy. Throughout 2019 and 2020, regulatory agencies will play a more significant role in crafting health, retirement and other benefits policies. These initiatives often do not receive the same media attention as Congressional legislative activity, but the impact can be just as important. Even if Congress does pass significant legislation, it will be the job of the regulatory agencies to fill in the crucial details. At the same time, a period of comparative legislative inactivity — particularly during the Congress preceding a presidential election — affords both parties the opportunity to scope and develop much broader policy proposals.
