Prior written notice is a relatively simple concept that can catch school officials off-guard. They often miss the triggers for a PWN, misjudge the timing for the notice, or fail to include the necessary information. These miscues may result in a denial of FAPE. Attorney Maureen Lemon will provide pointers to keep your district in legal compliance with this important IDEA procedural safeguard. You'll learn, through a review of administrative and court decisions, when the district should or should not send a PWN, the seven critical notice components, and how the PWN must be communicated to parents. A copy of a model PWN will be included in the presentation. This is a Fundamental Session.
