Mixed cases are confusing for practitioners and complainants alike. Because they involve an adverse action appealable to the MSPB and an EEO complaint appealable to the EEOC, a separate set of rules apply to their processing. Not knowing these rules can land the practitioner in a world of trouble! This advanced-level session assumes that the participants have a basic working knowledge of the mixed case complaint process. Using scenarios based on real fact patterns, Mr. Bogdanow and Mr. Names will engage the audience in a discussion of the thorny issues arising when actually processing mixed cases, including practical advice on how to handle constructive discharge allegations and application of the concept of severability of claims when mixed and non-mixed matters are raised in the same complaint.
