E30 Schedule Delay Insanity and a Path to be Sane (Room Chopin 4)

The cost to determine schedule delays in claims can shock the conscious, even more so when paid experts on each side come up with vastly different answers for the same delayed project. Is there a better path that we can agree upon? This panel will address the problem from the perspective of an in-house counsel working group AGC of America created on the issue. One possible solution is the recent issuance of the American National Standard Institute/American Society of Civil Engineers/Construction Institute industry standard for schedule delay analysis ANSI/ASCE/CI 67-17. The standard identifies 35 guidelines covering principles of CPM schedule delay analysis in eight categories including critical path, float, concurrent delay, and acceleration. The discussion will address the pros and cons to this possible emerging standard for options to conduct a delay analysis and the impact on training and compliance costs for contractors.

Upon completion of this session, participants will be able to:

  • Understand the industry standard for schedule delay analysis in the United States, ANSI/ASCE/CI 67-17 Schedule Delay Analysis.
  • Understand the implications of the standard to contractor, construction manager, and owner’s rep personnel with regards to schedule obligations.
  • Attendee will learn about Understand by case law, including proportionality of cost payment in acceleration situations and whether a contractor should be granted a time extension for delay to an early completion schedule.
