E12 The View from the Seat at the End of the Table: What Being an Arbitrator or Mediator Has Taught Us About Being Better Advocates (Room Chopin 2)

Three attorneys who have decades of experience as neutrals will team with a nationally renowned expert to explain what they've learned from being neutrals about how to be better advocates. Some advice will be practical (how to best handle exhibits) and some will be more theoretical (why fighting with your adversary is counter-productive).  All this will be supplemented by the insights of an expert, who will provide advice on how to get the most out of your expert to support your case, without the expert becoming too much of an advocate.

Upon completion of this session, participants will be able to:

  • Understand, from experienced neutrals, what works and what doesn't work when trying to persuade a fact finder, a neutral, and the opposing parties.
  • Understand practical tips about how to avoid common mistakes in presenting a case and how to streamline a presentation.
  • Understand the psychological challenges that a fact-finder or neutral faces, so as an advocate the attendee can present its case and conduct itself in a manner that is easiest for the fact-finder or neutral to accept.
