E01 Predicting Success: Predictive Coding Strategies for Successful Data Review in Construction Claims and Disputes - ABA (Room Chopin 3)

The deployment of predictive coding technology to reduce the enormous time and cost of culling large volumes of data from review has largely been underutilized in construction matters. This panel will take a deep dive into specific implementation strategies businesses lawyers can use to address the unique review challenges faced in construction claims, disputes and investigations. The panel will conduct an experiment using data sets from real legal matters to identify which strategies work best in the context of claims for change, delay, lost productivity and construction defects, and will discuss in detail the results of the case study.

Upon completion of this session, participants will be able to:

  • Understand why applying predictive coding strategies used on commercial cases is not always effective on construction cases.
  • Differentiate between predictive coding review strategies and determine which strategy works best for their particular claim or dispute.
  • Be empowered with the information they will need to implement and manage a specific construction predictive coding review as efficiently and effectively as possible.
