The pandemic uncovered potential issues in the leasing process and overall property management in the commercial industry. In this session, attendees will take away a myriad of best practices and lessons learned based on actual cases from the pandemic. This course will cover: • Pandemic defenses of force majeure, excuse of performance, impossibility, impartibility, frustration of purpose, illegality, and how to avoid them. • Amending your leases to provide specificity to vague terms, insurance coverage and concerns, annual requirements for tenant compliance reporting • How to provide for provisions and/or obligations to comply with state and local regulations including vendor access, masks, and PPE. • How to shift risk burdens to tenants, and how to respond to lease violations and access during a pandemic.
